Welcome to MLAGA Services

These Terms and Conditions ("Terms") govern your use of MLAGA Services ("Platform", "Service", "we", "us", or "our"), a WhatsApp-based service provider platform operating in Zimbabwe.

By using our platform, you agree to these Terms. Please read them carefully before registering or using our services.

Acceptance of Terms

By accessing or using MLAGA Services through WhatsApp or our website, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our services.

Eligibility

To use our services, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into binding agreements
  • Provide accurate and complete information during registration
  • Be located in or provide services within Zimbabwe
  • Comply with all applicable local laws and regulations

Service Description

MLAGA Services operates as an intermediary platform that:

  • Connects clients seeking services with registered service providers
  • Facilitates service discovery through our WhatsApp chatbot
  • Manages service provider registrations and subscriptions
  • Provides a platform for showcasing work portfolios
Important: MLAGA Services is a platform only. We do not provide the actual services and are not responsible for the quality, completion, or outcome of services provided by registered service providers.

Service Provider Obligations

If you register as a service provider, you agree to:

  • Provide accurate information about your services and qualifications
  • Maintain a valid subscription and make timely payments
  • Respond professionally to client inquiries
  • Deliver services as advertised and agreed upon with clients
  • Upload appropriate, work-related photos and videos only
  • Comply with all applicable professional standards and regulations
  • Handle client interactions and payments independently

Client Responsibilities

As a client using our platform, you agree to:

  • Provide accurate information about your service requirements
  • Communicate clearly and professionally with service providers
  • Make payment arrangements directly with chosen service providers
  • Respect service providers' time and professional boundaries
  • Provide feedback honestly and constructively

Subscription and Payment Terms

Service provider subscriptions are subject to the following terms:

  • Monthly Fee: USD $20.00 per month (or equivalent in local currency)
  • Payment Methods: EcoCash, bank transfer, or Innbucks
  • Billing Cycle: Monthly, in advance
  • Late Payments: Accounts may be suspended for non-payment
  • Refunds: No refunds for partial months or unused services
  • Price Changes: We may adjust pricing with 30 days' notice

Payment confirmation must be provided through proof of payment (POP) upload within 7 days of payment due date.

Platform Usage Rules

When using our platform, you must not:

  • Provide false, misleading, or incomplete information
  • Upload inappropriate, offensive, or copyrighted content
  • Use the platform for illegal activities or services
  • Attempt to circumvent our matching system
  • Spam or harass other users
  • Share login credentials or allow unauthorized access
  • Reverse engineer or attempt to access our systems improperly

Content and Intellectual Property

Regarding content uploaded to our platform:

  • You retain ownership of content you upload
  • You grant us a license to display and use your content for platform operations
  • You confirm you have rights to all uploaded content
  • We may remove content that violates our guidelines
  • Our platform design, software, and branding remain our intellectual property

Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy. By using our services, you consent to such collection and use as outlined in our Privacy Policy.

Limitation of Liability

IMPORTANT LIMITATION: To the fullest extent permitted by law:

  • MLAGA Services is provided "as is" without warranties
  • We are not liable for service provider performance or client satisfaction
  • We are not responsible for disputes between clients and service providers
  • Our total liability for any claims shall not exceed the amount paid by you in the last 12 months
  • We exclude liability for indirect, consequential, or punitive damages

Indemnification

You agree to indemnify and hold harmless MLAGA Services from any claims, damages, or expenses arising from:

  • Your use of our platform
  • Your violation of these Terms
  • Your interactions with other users
  • Any content you upload or share
  • Any services you provide or receive through our platform

WhatsApp Integration

Our platform integrates with WhatsApp Business API. Please note:

  • WhatsApp's terms of service also apply to your use of messaging features
  • We are not responsible for WhatsApp service availability or performance
  • Message delivery is subject to WhatsApp's systems and policies
  • You are responsible for your own WhatsApp account security

Suspension and Termination

We may suspend or terminate your access to our platform if:

  • You violate these Terms
  • Your subscription payments are overdue
  • You engage in fraudulent or illegal activity
  • You harm other users or the platform reputation

You may terminate your account at any time by contacting us through WhatsApp. Upon termination, your subscription will not be refunded for the current billing period.

Dispute Resolution

In case of disputes:

  • First, contact us via WhatsApp to seek resolution
  • If unresolved, disputes shall be governed by Zimbabwean law
  • Legal proceedings must be conducted in Zimbabwe
  • We encourage mediation before formal legal proceedings

Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, internet outages, or technical failures.

Changes to Terms

We may modify these Terms from time to time. We will notify users of material changes through:

  • WhatsApp notifications
  • Website updates
  • Email notifications (where applicable)

Continued use of our services after changes constitutes acceptance of the modified Terms.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue to be valid and enforceable to the fullest extent permitted by law.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MLAGA Services regarding your use of our platform.
